新农村建设中红色文化遗产法律保护的经济学分析

文章基于公共物品私人供给的模型,构建了新农村建设时期乡村红色文化遗产保护过程中村民在个体理性支配下同集体理性进行博弈的分析框架,并据此对实践中存在的保护政策失效和村民间保护意愿差异的现象进行了解析。结论认为,村民在个体理性支配下的博弈行为符合福利经济学基本理论,构成了保护政策失效的主要原因;为此,结合村民的行为特点和福利经济学的分析,引入了法律保护机制以探求思路和对策。     

内部性解决机制的比较分析

交易成本或不完全信息是内部性产生的主要原因,由于交易成本和不完全信息是普遍存在的,所以内部性也是普遍存在的.市场机制、法律程序、社会性管制都在一定范围、一定程度上对解决内部性问题发挥作用.只有当因交易成本过高使市场解决内部性无效时,社会性管制才作为一种替代性的机制发挥作用.

Legal regulation of enterprises＇ environmental impact：a survey

The enterprise coordinates social resources, which changes the dialogue between human and the environment into that between enterprise and environment. The profit-making character of enterprise leads to the abandonment of environmental ethics. Enterprise, which has the capability to solve environmental problems, however, lacks the motive to do it. It has controlling power over society and should assume the responsibility of environmental protection. For its lack of environmental conscience, the external institutional arrangements should be made for enterprise. The strategy for environmental cost should be designed in connection with the interest orientation of enterprise. And various legal measures in constitutional law, social law, civil law, administrative law and criminal lave should be utilized to regulate enterprise＇s behaviors regarding environmental protection.     

高等学校会计制度改革初探

随着我国高等教育改革的不断深入,高校的会计环境发生了显著变化,现行会计制度已经难以适应高等教育事业发展的需要。针对当前高校会计制度存在的问题,借鉴国外高等学校的通行做法,吸收企业会计改革的成功经验,高校会计制度改革应引入权责发生制、建立完善的会计科目体系、完善会计报表体系、加强会计队伍建设。     

法治进步倒逼我国会展业发展转型——以展品的产品责任风险为例

我国会展业近30年的粗放发展已经与外部社会环境和法治进步形成了某种风险反差,而长期以来业内对风险的模糊意识和无所作为也不断侵蚀着行业发展的可持续性。例如,《侵权责任法》上产品责任是商业展会的一项集中风险,它蕴藏在各种展品之中。我国相关法律条文及判例已彰显展会组织者需为此担责的指向。其中,《消费者权益保护法》第43条更载明展会组织者为此承担"无过错责任"。1[1]这符合"消费者特别保护"的国际潮流、客观上也使展会组织者风险陡然高企。更为重要的是:这将倒逼我国会展业由外延发展向内涵发展的模式转型,是行业走向成熟的客观必然。     

The leadership disease. . .and its potential cures

Leadership development and executive education have taken on increased prominence in recent years. The natural tendency is to approach the subject of leadership as a hierarchically-based process that is focused on higher-level individual leaders influencing lower-level followers. This tendency is consistent with myths surrounding charismatic and heroic visionary leaders who are often portrayed as single-handedly inspiring and directing their organizations to new heights. Unfortunately, these simplistic portrayals of leadership are promulgated by the media and desired by the consuming public. However, this kind of framing of leadership is dangerous: it lays the seeds of centralization of power, which can have innumerable detrimental outcomes. Accordingly, we explore two potent antidotes to this simplistic hierarchical formulation of leadership that have become an increasing focus of leadership research: self-leadership and shared leadership.     

Contextual analysis of legal systems and their impact on trade and foreign direct investment

Differences among nations in legal tradition play a role in foreign direct investment decisions by multinational firms. How large a role and to what degree these factors impact the success of foreign direct investment are important issues for examination. A principal question is whether macro-differences in legal systems are causal for international investment on a stand-alone basis or subordinate to multiple other legal variations and societal considerations. This article examines the historical roots and nature of varying legal systems, traditions, and cultures that continue to affect international business. The study analyzes other major conditions which surround the legal environment in investment target countries such as system transparency, degree of corruption, adequate enforcement, and issues of bias related to foreign-owned firms. In addition, firms may have varying strategic objectives for foreign direct investment which may not be driven by short term profitability.     

A study of the impact of Corporate Social Responsibility and price image on retailer personality and consumers' reactions (satisfaction,trust and loyalty to the retailer)

This study investigates the impact of a retailer's Corporate Social Responsibility (CSR) policy and its price image on retailer personality, along with the impact of these two variables on the consequences of retailer personality: consumers' satisfaction, trust and loyalty toward the retailer (measured by their attitude and future behavioral intentions). Data were collected on a convenience sample of 352 consumers of a French grocery retailer. Using Partial Least Squares analysis (PLS), we show that perceived Corporate Social Responsibility and price image have a significant positive/negative influence on retailer personality traits (“agreeableness” and “conscientiousness”/“disingenuousness”) and that Corporate Social Responsibility has also a significant positive influence on the “sophistication” personality trait. For the consequences examined (satisfaction, trust and loyalty to the retailer), we show that Corporate Social Responsibility, price image and retailer personality have a direct or indirect impact on these dependent variables.

通过分析药品不良反应的含义和分类,讨论药品不良反应责任适用的法律,得出药品常见且可预期的药品不良反应和特异体质型药物过敏反应,药品生产者、销售者和医疗机构没有过错可以不承担法律责任,药品常见且可预期之外的药品不良反应是药品缺陷,这种情况依据《侵权责任法》,药品生产者、销售者和医疗机构应承担相应的法律责任。
